from washington, pete williams. let's talk about dzhokhar tsarnaev. he isn't talking yet but he's communicating. what more do we know about that and let's also talk about the issue of whether or not charges are coming today. >> okay. in terms of his communication, we're told that they are asking him questions for brief periods of time and that he is responding to some questions in writing. we don't know how complete or how thorough this is only that he's conscious and that he is responding to these questions, which during this stage will have to be confined to the issue of whether there's a continuing threat, whether other people were working with him, whether there were other bombs out there, things of that nature. now, on the question of whether charges or when they'll be filed, i think the best way to start to think about this, thomas, and this is just my own supposition here is best way to think about this is when will we learn what charges are? i say that because if you think about all of the things that could be going on here, charges could be filed under seal and we don't

to do it with the names. dzhokhar tsarnaev telling authorities how and why they planned the attack. >> good morning. dzhokhar tsarnaev remains in serious condition here but now he is facing serious charges as well. the use of a weapon of mass destruction and malicious destruction of property resulting in death. he was arraigned from his hospital bed before a federal magistrate who determine he was alert, mentally competent and lucid. and now we know he has begun to communicate. he was able to nod during this hearing and he said one word -- "no" -- when asked if he could afford a lawyer. court papers line out the time saying tsarnaev was caught in the area before the bombing 11 minutes before and was seen fiddling with his cell phone shortly before the blast. tsarnaev is communicating with authorities revealing the internet provided a lot of information on this attack and there was no foreign help. sources tell abc that tsarnaev claims they had no direct financing from governments or rogue groups -- or rogue groups overseas, and that the younger brother may not have known about this

a description of a still unreleased fbi video. according to those familiar with what it shows, dzhokhar tsarnaev can be seen removing his backpack at the spot where the second bomb was placed, and acting very differently from those around him when e first bomb blew up. >> this suspect took the backpack off, put it down, did not react when the first explosion went off, and then moved away from the backpack in time for the second explosion. >> federal officials say in the hours after the fbi released photos of the bombing suspects thursday night, investigators had not yet matched any names to their pictures and, in fact, did not even have the tsarnaev brothers in any terrorist data base. only after the older brother was killed in the late night shootout in watertown were agents able to check his fingerprints and put actual names to their case. fbi agents are seeking to interview all the family members and friends of the two brothers, including the wife of the older one, tamerlan. her lawyer says he is talking to federal authorities about how to proceed. matt? >> pete williams, thank you very much.

of the runners wore black ribbons on their vests in tribute. >>> dzhokhar tsarnaev is in serious but stable condition. he has a gunshot wound to his neck. so far he has been unable to speak to authorities but is reportedly responding sporadically and writing to questions. police captured tsarnaev in a dramatic fashion on friday night in a boat in a backyard in watertown, massachusetts. federal prosecutors could file criminal charges against him as early as today. they are questioning tsarnaev under a public safety exemption which means he doesn't have the right to remain silent because they believe there is an imminent threat to the public. however, when exemption expires there are some members of congress republican members of congress calling on authorities to declare him an enemy combatant and hold him for 30 days in order to continue to interrogate him. we're back with more show after the break. stay with us.
